The curtain has been raised for the final scene in the Viransehir scandal. The indictment prepared by the Diyarbakir DGM is calling for up to five years prison for each of 13 children.

Cases have been opened in the Diyarbakir State Security Court (DGM) against a number of children who were detained in the Viransehir district of Urfa on the grounds that they had shouted slogans. The DGM prosecutor is asking sentences of 5 years each for 13 children.

The DGM has completed its investigations against the 28 children who were detained on the grounds that they had held an unauthorized demonstration and shouted slogans. 22 of the children have been released from prison. The investigation, carried out by Diyarbakir DGM Prosecutor H. Sami Kuzu, concluded that there was no evidence to warrant a case against 15 of the children, but ruled to indict 13 of them.

The indictment prepared by Kuzu asserts that 13 children between the ages of 11 and 15 had gathered in the Demirel neighborhood of Viransehir with the aim of protesting F-type (isolation cell) prisons and that during the march, they had clapped and chanted pro-PKK slogans such as "Long live the PKK" and "Long live President Apo." The indictment asserts that the children were captured while they were trying to escape by security forces who arrived on the scene and continues: "It has been understood from the testimony of the suspects, from the records of the eventful capture, and within the scope of all the documents that the suspects committed the crime of aiding and abetting, and thereby assisted the organization by supporting them through their actions which make their [the PKK's] activities easier." The DGM prosecutor asked that the following children receive sentences of up to five years each on charges of violating Turkish Penal Code (TCK) 169, aiding and abetting an illegal organization: O.D. (15), L.E. (16), F.D. (15), M.Y. (16), B.D. (15), M.S. (16), S.K. (14), S.K. (14) H.K. (13), Y.K. (11), A.D. (13), T.G. (13) and H.Y. (11).

The case is unfortunate

Attorney Mahmut Vefa, General Secretary of the Diyarbakir Bar Association, termed the case against the 13 children "unfortunate." Vefa said that the young children had confessed to the charges because they had been frightened and added that they were all in the same condition. Vefa said that they had expected that the court would rule not to pursue the case, but that all would come out into the open in the hearings ahead.

Imprisoned children

Attorney Cihan Aydin, member of the Human Rights Association (IHD), said that they would file another objection with the DGM for their 6 clients who remain detained in Urfa prison. Aydin added that the cases opened against the 13 children were contrary to international agreements and that the charged were legally children according to Turkish law. Aydin said that the arrests had trampled on these agreements and continued: "When the children confessed to the charges, they did not know what to expect ahead. These children are suffering serious trauma. The six [detained] children are in very bad condition now that the other 22 children have been released. Our hope is that these will be released as well."
